 Julius Abure's Leadership Cemented: Appeal Court Upholds Labour Party Chairmanship

In a landmark decision on January 17, 2025, the Court of Appeal in Abuja reaffirmed Julius Abure as the National Chairman of the Labour Party (LP). 



Court's Verdict

A three-member panel, led by Justice Hamma Barka, upheld its prior judgment from November 13, 2024, confirming Abure's leadership. The court emphasized that this decision remains unchallenged by any other judicial authority. 

Appeals Dismissed

The ruling addressed appeals from Senator Esther Nenadi Usman, who chaired a caretaker committee, and the Independent National Electoral Commission (INEC). The court clarified that internal party leadership disputes are non-justiciable, meaning they cannot be resolved through the judiciary. Consequently, it declared any actions taken without proper jurisdiction as null and void, including the Federal High Court's October 8, 2024, judgment by Justice Emeka Nwite. 

INEC's Position

Previously, INEC had questioned the legitimacy of the LP's national convention, alleging it violated the Nigerian Constitution and the Electoral Act. The commission contended that the party did not meet the legal prerequisites for holding the convention and asserted that Abure's tenure had expired in June 2024. 

Federal High Court's Prior Judgment

On October 8, 2024, Justice Emeka Nwite of the Federal High Court in Abuja affirmed Abure's leadership and the validity of the March 2024 Nnewi convention, which produced the current party executives. The court ordered INEC to recognize Abure as the legitimate chairman, countering the commission's earlier stance. 





This appellate court decision solidifies Julius Abure's position at the helm of the Labour Party, providing clarity amid previous leadership disputes. The ruling underscores the judiciary's stance on non-interference in internal party affairs, setting a precedent for similar cases in the future. 

The affirmation of Julius Abure as the National Chairman by the Court of Appeal not only resolves the internal leadership tussle but also reinforces the autonomy of political parties in managing their affairs without judicial intervention. This decision is pivotal for the Labour Party as it navigates its future political engagements.
