Supreme Court Dismisses Fubara’s Appeal Against Amaewhule-Led Assembly

A landmark ruling from the Supreme Court of Nigeria has dismissed an appeal filed by Rivers State Governor, Siminalayi Fubara, challenging the leadership of the Rivers House of Assembly under Speaker Martin Amaewhule. The five-man panel, led by Justice Uwani Abba-Aji, imposed a cost of ₦2 million against Governor Fubara, payable to the Rivers Assembly as the first respondent and Speaker Amaewhule as the second respondent.

Background of the Case

The legal battle began when Governor Fubara presented the 2024 budget to the Edison Ehie-led faction of the Rivers State House of Assembly in December 2023. However, on October 10, 2024, the Court of Appeal in Abuja upheld an earlier judgment by the Federal High Court, declaring the budget’s passage unlawful. The lawmakers aligned with former Governor Nyesom Wike, led by Martin Amaewhule, took the matter to court, arguing that the budget had not been properly passed.

The Supreme Court’s Decision

The Supreme Court’s decision to dismiss the appeal followed the withdrawal of the suit by Fubara’s legal counsel, Yusuf Ali. With this ruling, the leadership structure of the Rivers Assembly under Amaewhule remains intact. The court’s ruling has significant implications for the political landscape in Rivers State, as it solidifies the position of the Amaewhule-led faction.

The dismissal of the appeal is seen as a victory for the Amaewhule-led faction and a setback for Governor Fubara. The ongoing political rift between Fubara and his predecessor, Wike, over the control of political structures in Rivers State has been a major factor in this legal battle. The court’s decision may further entrench the divisions within the state’s political landscape.

Reactions and Future Outlook

The ruling has drawn mixed reactions from various stakeholders. While supporters of the Amaewhule-led faction view the decision as a validation of their position, critics argue that it highlights the need for legal reforms to ensure fair and transparent governance. The future of Rivers State’s political dynamics will depend on how the various factions navigate this complex legal and political landscape.
